1. TERMS

By accessing the website at https://flowster.app, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. USE LICENSE

  1. Permission is granted to temporarily download or access one copy of the materials (information or software) on Flowster’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained on Flowster’s website;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or “mirror” the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Flowster at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. DISCLAIMER

  1. The materials on Flowster’s website are provided on an ‘as is’ basis. Flowster makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Flowster does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
  3. Features offered by Flowster are subject to change without notice.

4. LIMITATIONS

In no event shall Flowster or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Flowster’s website, even if Flowster or a Flowster authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. ACCURACY OF MATERIALS

The materials appearing on Flowster website could include technical, typographical, or photographic errors. Flowster does not warrant that any of the materials on its website are accurate, complete or current. Flowster may make changes to the materials contained on its website at any time without notice. However Flowster does not make any commitment to update the materials.

6. LINKS

Flowster has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Flowster of the site. Use of any such linked website is at the user’s own risk.

7. YOUR DATA

Certain features of the service may permit you to upload content to Flowster, including documents, messages, photos, video, images, folders, data, text, and other types of works (“User Content”) – and to publish your content on the service. You retain any copyright and other proprietary rights that you may hold in the User Content that you post to the service.

By submitting, posting or displaying your content to the Flowster marketplace, you give Flowster and its affiliated companies, sublicensees (including third parties whose products, technologies and services use or interface with any specific parts of a Flowster software or service that includes the content) and other users of the website, a perpetual, irrevocable, transferable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute said content.

8. ACCEPTABLE USE

Our mission at Flowster is to help you and your team do twice your work in half the time. To do this, we need to keep our service running smoothly, quickly, and without interruption. In order for this to happen, we need help from all our users.

Here’s what is not allowed:

  1. Tampering with, reverse-engineering, or hacking our services, circumventing any security or authentication measures, or attempting to gain unauthorized access to the services, related systems, networks, or data.
  2. Deciphering any transmissions to or from the servers running the services.
  3. Compromising the integrity of our systems. This could include probing, scanning, or testing the vulnerability of any system or network that hosts our services. This prohibition does not apply to security assessments expressly permitted by Flowster.
  4. Modifying, disabling, or compromising the integrity or performance of the services or related systems, network or data.
  5. Overwhelming or attempting to overwhelm our infrastructure by imposing an unreasonably large load on our systems that consume extraordinary resources (CPUs, memory, disk space, bandwidth, etc.), such as:
    1. Consuming an unreasonable amount of storage for your content.
    2. Your division using an extraordinarily high amount of resources due to an unreasonable amount of content (templates, workflows, etc) or users.
    3. Using “robots,” “spiders,” “offline readers,” or other automated systems to send more request messages to our servers than a human could reasonably send in the same period of time by using a normal browser.
    4. Sharing the same login credentials between multiple devices or individuals.

9. RESALE

No Resale. Ordered Flowster Services shall not be sold/resold, leased/subleased, licensed/sublicensed, or otherwise made available to any other third party. All your usage shall be for your own internal business use.

10. ABUSE

You may not use Flowster’s services to engage in, foster, or promote illegal, abusive, or irresponsible behavior, including:

  • Any activity or conduct that is likely to be in breach of any applicable laws, codes or regulations, including data protection and privacy laws and laws relating to unsolicited commercial electronic messages;
  • Use of an internet account or computer without the owner’s authorization;
  • Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network;
  • Monitoring data or traffic on any network or system without the express authorization of the owner of the system or network;
  • Introducing intentionally, knowingly or recklessly, any virus or other contaminating code into the Services;
  • Collecting or using information, including email addresses, screen names or other identifiers, by deceit, (such as, phishing, Internet scamming, password robbery, spidering, and harvesting);
  • Use of any false, misleading, or deceptive TCP-IP packet header information in an email or a newsgroup posting;
  • Distributing software that covertly gathers or transmits information about a user;
  • Distributing advertisement delivery software unless: (i) the user affirmatively consents to the download and installation of such software based on a clear and conspicuous notice of the nature of the software, and (ii) the software is easily removable by use of standard tools for such purpose included on major operating systems (such as Microsoft’s “add/remove” tool);
  • Any conduct that is likely to result in retaliation against the Flowster network or website, or Flowster’s employees, officers or other agents, including engaging in behavior that results in any server being the target of a denial of service attack (DoS);
  • Any activity intended to withhold or cloak identity or contact information, including the omission, deletion, forgery or misreporting of any transmission or identification information, such as return mailing and IP addresses;
  • Interference with service to any user of the Flowster or other network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
  • Any action which directly or indirectly results in any of our IP space being listed on any abuse database (i.e. Spamhaus);
  • Conducting any gambling activity in violation of any required licenses, codes of practice, or necessary technical standards required under the laws or regulations of any jurisdiction in which your site is hosted or accessed; or
  • Any action that is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to Flowster.

11. FEES & PAYMENTS

Pricing for Flowster products or services is subject to change without notice.

  1. Subscription Plans. The subscription period for the Monthly Plan will be one month. The subscription period for the Annual Plan will be one year. All Plans will automatically renew unless you cancel your Plan in accordance with these Terms at least one (1) business day prior to the renewal date. You will be billed monthly for the Monthly Subscription Plan on or about the same day each month until such time that you cancel your Monthly Subscription Plan. You will be billed annually for the Annual Subscription Plan on or about the same day each year until such time that you cancel your Annual Subscription Plan.
  2. Refunds:
    1. On Subscription Plans. By accepting these terms, you agree that you are responsible for canceling your subscription, prior to your subscription’s re-bill date, or prior to your trial end date. Failure to do so will result in your payment method being charged, with no refund offered.
    2. On Marketplace Purchases. If the product you purchased is not what you were expecting, you can request, within 7 days of your purchase, that Flowster refunds the purchase. This gives you plenty of time to evaluate the product and determine if it’s valuable.

      We reserve the right to apply a credit or a refund, at our discretion, depending on capabilities of our payment processing partners. No credit or refund is due to you if you request it after the 7-day guarantee time limit has passed.

      At our discretion, if we believe you are abusing our refund policy, we reserve the right to ban your account and to restrict all future use of the Services. If we ban your account due to your violation of these Terms, you will not be eligible to receive any credit or refund.

  3. Marketplace Sellers:
    1. Payments. We will pay you eighty-five percent (85%) of the Net Amount received for your Marketplace product, less any applicable deductions such as Customer refunds.

      So that Flowster can pay you in a timely manner, you must have a PayPal account or a Stripe account in good standing and keep Flowster apprised as to the correct email address associated with your PayPal or Stripe account. Payment will be made within thirty (30) days of the end of the month in which the fee for a Marketplace product was received. You are responsible for providing Flowster with all identifying and tax information necessary for the payment of amounts due.

      As a Marketplace Seller, you are responsible for determining whether you are eligible to be paid by a US company.

12. CANCELLATIONS

Flowster Services will continue in effect until Customer validly terminates the Services. Customer must notify Flowster of its intent to terminate Service at least one (1) business day before the billing renewal date. If notice is not received before such date, Services will automatically renew for the subsequent renewal period.

13. MODIFICATIONS

Flowster may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

14. GOVERNING LAW

These terms and conditions are governed by and construed in accordance with the laws of Nevada, USA, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
